Purpose

These terms govern access to smartbs.tn and use of SmartBS services (online store, point of sale, business management, freight forwarding, marketplace and related services). By creating an account or subscribing to an offer, you accept these terms.

Account and free trial

Creating an account requires accurate information and a password you keep confidential; you are responsible for activity on your account.

A free trial is offered: its length and included modules are shown at sign-up. When it ends, your account moves to a limited plan unless you subscribe to a paid offer.

Offers, prices and payment

Prices shown exclude taxes (VAT); applicable VAT is added. Launch offers are billed yearly, in the currency shown (Tunisian dinar, euro or US dollar).

The free domain name included with a launch offer is configured by our team; its duration and renewal terms are specified at subscription.

Payment is due at subscription or renewal depending on the chosen method. If payment fails, we may suspend access after notice.

Term, renewal and termination

The subscription runs for the chosen period. You may request termination at any time by email; it takes effect at the end of the current period, with no refund of the period already started, unless mandatory law provides otherwise.

We may terminate or suspend an account for a serious breach of these terms after an unanswered notice, except in urgent cases (fraud, security breach).

Acceptable use

You agree not to use the platform for illegal or misleading activities or ones that infringe third-party rights, not to try to disrupt it or access data that is not yours, and to comply with the rules applicable to your business (online selling, consumer protection, personal data).

Your data and content

You remain the owner of the content and data you store on the platform and are responsible for its lawfulness, notably towards your own customers. We process it according to the privacy policy. You may request an export of your data before closing your account.

Intellectual property

The platform, its software, trademarks, logos and content belong to SmartBS or its licensors. The subscription gives you a personal, non-exclusive, non-transferable right of use for its duration.

Availability and support

We use reasonable means to keep the service available but do not guarantee uninterrupted availability: maintenance or incidents beyond our control may interrupt it. Support is available by email, phone and WhatsApp.

Liability

Our liability is limited to direct, foreseeable damages, up to the amounts paid for the subscription over the last 12 months, except in case of gross negligence, wilful misconduct or mandatory law. We are not liable for indirect damages (lost revenue, reputation or customers). Artificial intelligence services provide suggestions that should be reviewed before use.

Governing law and disputes

These terms are governed by Tunisian law. Disputes are first sought to be settled amicably; failing that, the courts of Tunis have jurisdiction, without prejudice to mandatory rights consumers hold in their country of residence.

Changes

We may change these terms; the version in force is the one published on this page on the date of your order or renewal.
